Statement on the Texas Medical Abortion Case

Statement by National NOW President Christian F. Nunes About Texas Abortion Pill Ruling 

WASHINGTON–Today’s ruling on medication abortion by Texas Judge Matthew Kacsmaryk could bring down another grim curtain on the bodily autonomy and reproductive health care rights of women. 

Judge Kacsmaryk, a lifelong right-wing activist who was hand-picked by Donald Trump to advance an extremist agenda, revoked the FDA’s approval of Mifepristone, one of two drugs used in medication abortion. 

Like the Dobbs case that was crafted to lead to a nationwide ban on abortion, this lawsuit, filed by an entity designated as a hate group by the Southern Poverty Law Center, is designed to outlaw medication abortion not just in Texas but in all 50 states.  

NOW members will not tolerate any more lies about safe and effective medicine, or junk science arguments that have nothing to do with protecting women—and everything to do with the power politicians and judges want to keep over women’s bodily autonomy.   

They want to keep women from accessing abortion care in a doctor’s office, a clinic, a hospital, or now, in their own homes. 

An appeal of this dangerous ruling will go to the notorious 5th Circuit—the most conservative appeals court in the U.S. and the same court that allowed Texas SB 8 to go into effect before the Supreme Court ruled on Dobbs.   

NOW will continue to fight for medication abortion care as this issue gets debated, lied about and litigated.  We will join this fight in every state, and all the way to the Supreme Court.
