NOW Responds to “Wrongful and Unprecedented” Step by Archivist of the U.S. to Influence Certification of the Equal Rights Amendment 

Statement by National NOW President Christian F. Nunes 

WASHINGTON, D.C. —Christian F. Nunes, National NOW President, issued the following statement on the announcement by the national archivist that she would not certify the Equal Rights Amendment as part of the Constitution. 

“This is a wrongful and unprecedented move by a federal official with a clear and limited ministerial role to inject herself into a clear constitutional process.  NOW joined with a broad coalition of advocacy groups, constitutional scholars and legal experts who argued that the original seven-year deadline was unconstitutional, and now that the ERA has been ratified by 38 states, surpassing the original threshold, any further delay can only be seen as willful obstruction of gender equality. 

That’s not where President Biden’s heart is—women know where he stands.  That’s why NOW joins Sen. Kirsten Gillibrand in urging Joe Biden to instruct the archivist to certify and publish the ERA and codify equality in the Constitution. 

Do the right thing, Mr. President.  We need your strong voice for full constitutional equality.
